Terms of Service
1. Overview
These Terms of Service (“Terms”) govern your purchase and use of Alerta Home devices (“Devices”) and related software and services (collectively, the “Services”) provided by Alerta Family, Inc. (“Alerta,” “we,” “us,” or “our”). By purchasing a Device, creating an account, or using the Services, you agree to these Terms.
The Subscription Terms, Privacy Policy, and Acceptable Use Policy are incorporated by reference and form part of these Terms.
Alerta Home is a system of smart Devices and software designed to support family members and caregivers by providing activity visibility and notifications. Certain features require an active subscription.
Important: Alerta Home does not provide medical advice, diagnosis, treatment, or emergency services and is not a substitute for professional medical care or supervision.
2. Device and Subscription Relationship
Some functionality of Alerta Home Devices depends on an active subscription. Without an active subscription, Device functionality may be limited.
Service availability depends on factors outside our control, including power, internet or cellular connectivity, and third-party service providers.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate and current information and to promptly update your account information as needed.
4. Acceptable Use
Your use of the Services is subject to the Acceptable Use Policy (“AUP”), which is incorporated herein.
You may not:
- Misuse the Services or interfere with their operation
- Attempt to bypass security or access controls
- Use the Services for unlawful purposes
- Reverse engineer, tamper with, or attempt to extract source code from Devices or software
Violations of the AUP may result in suspension or termination of your account in accordance with these Terms. We may update the AUP from time to time.
5. Subscription Requirement
An active subscription is required for continued access to monitoring, notifications, and data services associated with Alerta Home Devices.
- Subscriptions are billed on a recurring monthly basis and automatically renew unless canceled prior to the renewal date.
- Subscription fees are disclosed at the time of purchase and charged to your selected payment method.
- You may cancel your subscription at any time through your account. Cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable unless otherwise required by law.
- If a payment fails, we may retry the charge and, if unresolved, suspend or terminate access to subscription features.

6. Privacy
Our Privacy Policy explains how we collect, use, and protect information related to your use of the Services and Devices.
7. Disclaimers
The Services and Devices are provided “as is” and “as available.”
Alerts and notifications are informational only and should not be relied upon as the sole basis for safety, caregiving, or care decisions. You are responsible for determining appropriate responses to information provided by the Services.
8. Limitation of Liability
To the fullest extent permitted by law, Alerta shall not be liable for any indirect, incidental, consequential, or special damages, including loss of data, service interruptions, or reliance on alerts or notifications, even if advised of the possibility of such damages.
9. Termination
We may suspend or terminate your access to the Services if you violate these Terms, the Acceptable Use Policy, or applicable law.
Termination may result in loss of access to subscription features and associated data, subject to applicable law and our data retention practices.
10. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles.
11. Changes
We may update these Terms from time to time. Changes will be effective when posted with a revised effective date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
